Terms of Service

1. Introduction and acceptance

These Terms of Service ("Terms") govern your access to and use of BurbleLabs, including our website, applications, and related services (collectively, the "Platform"), operated by ML Data Products Inc., a Delaware corporation ("BurbleLabs," "we," "us," or "our").

By creating an account, recording a call, joining a call as an invited participant, reviewing recordings, or otherwise using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.

If you are using the Platform on behalf of an organisation, you represent that you have authority to bind that organisation, and "you" refers to both you and that organisation.

2. Definitions

"Contributor" means a registered user who initiates and participates in a Call in order to earn payment for the resulting Recording.

"Reviewer" means a registered user who listens to and evaluates Recordings for quality, accuracy, and compliance with these Terms.

"Call Participant" or "Friend" means any individual invited by a Contributor to join a Call, whether or not that individual creates a BurbleLabs account.

"Call" means a live voice conversation conducted through the Platform between a Contributor and a Call Participant.

"Recording" means the audio file and any associated metadata or transcript generated from a Call.

"Buyer" means any third party — including AI developers, research institutions, and technology companies — that licenses Recordings or datasets from BurbleLabs.

"Earnings" means amounts credited to a user's BurbleLabs balance for approved activity on the Platform.

3. Eligibility

You must be at least 18 years old to create a BurbleLabs account, act as a Contributor, or act as a Reviewer. By registering, you represent that you meet this requirement and that all information you provide is accurate and current.

Call Participants who are invited to a Call but do not hold an account must also confirm, before joining, that they are at least 18 years old and that they consent to being recorded. BurbleLabs reserves the right to reject, discard, or refuse to pay out for any Recording where this cannot be reasonably confirmed.

We may refuse service, suspend, or terminate any account at our discretion, including where we reasonably believe these Terms have been violated.

4. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use.

You may not create more than one account, share your account with another person, or transfer your account without our written consent.

5. Recording and consent

5.1 Contributor consent. By initiating a Call, you consent to that Call being recorded in full, and you confirm that you have obtained, or will obtain before the Call begins, the informed consent of your Call Participant to be recorded on the same basis.

5.2 Call Participant consent. Before any Call Participant joins a Call, the Platform will present a clear consent notice explaining that the conversation will be recorded, how the Recording may be used, and requiring affirmative opt-in. No Recording will proceed to review or licensing without this consent having been captured and logged.

5.3 Nature of Recordings. Calls are intended to capture natural, unscripted conversation. You agree not to read from a script, use text-to-speech, insert synthetic or AI-generated audio, or otherwise misrepresent the authenticity of a Recording.

5.4 Withdrawal of consent. Either the Contributor or the Call Participant may withdraw consent and request deletion of a specific Recording at any time before it has been licensed to a Buyer, by contacting us at privacy@burblelabs.com. Once a Recording has been licensed and delivered to a Buyer, withdrawal may not be technically possible for that already-delivered copy, and this limitation will be explained at the point consent is given.

6. Content standards

Recordings must not contain, and Calls must not be used to produce:

  • Content involving minors in any sexual, exploitative, or unsafe context
  • Hate speech, harassment, or content that incites violence
  • Sexually explicit content
  • Illegal activity, including the planning or facilitation of illegal acts
  • Personal data of third parties who have not consented (e.g. reading out another person's private information)
  • Impersonation of a real individual without their consent

We reserve the right to reject, remove, or refuse payment for any Recording that violates this section, and to suspend or terminate accounts of repeat or serious offenders.

7. Reviewer role and responsibilities

Reviewers agree to assess Recordings honestly and to the best of their ability, applying the quality criteria presented in the review interface. Reviewers must not approve Recordings they have not genuinely listened to, and must not collude with Contributors to approve ineligible Recordings.

BurbleLabs may periodically spot-check Reviewer decisions for quality assurance. Reviewers found to be approving content in violation of Section 6, or engaging in fraudulent review activity, will have their account suspended and any related pending Earnings forfeited.

Each Recording will be reviewed by one Reviewer under the current process. BurbleLabs may introduce multi-reviewer verification for some or all Recordings at its discretion, without obligation to apply this retroactively.

8. Payments and Earnings

8.1 Contributor pay. Contributors earn a per-minute rate for approved Recordings, calculated on the duration of the approved audio and the rate applicable to the relevant language and dialect at the time the Call was completed. Rates are set by BurbleLabs and may change at any time; the rate applicable to a given Call is the rate in effect when that Call was completed, not when it is later reviewed.

8.2 Reviewer pay. Reviewers earn a per-audio-minute rate for completed reviews, at the rate in effect at the time the review is submitted. Rates may vary and may change at any time on a forward-looking basis.

8.3 Approval is not guaranteed. Submitting a Recording or a review does not guarantee payment. Earnings are only credited once a Recording (or review) has been approved under BurbleLabs' quality process. Rejected Recordings and reviews earn no payment except as otherwise expressly stated.

8.4 Withdrawals. Earnings accrue to your account balance as "pending" and become eligible for withdrawal once approved. A minimum balance (currently $5 USD, subject to change) applies before a withdrawal can be requested. Withdrawals are paid to the payout method on file (currently PayPal) and are subject to processing time and any fees charged by the payment provider.

8.5 Taxes. You are solely responsible for determining and paying any taxes owed on Earnings received through the Platform. BurbleLabs may be required to collect tax information from you and to report payments to tax authorities where legally required.

8.6 Fraud and reversal. BurbleLabs may withhold, reverse, or reclaim Earnings obtained through fraud, abuse, fake accounts, misrepresentation, or violation of these Terms, including after payout, to the extent permitted by law and the payment method used.

9. Referral program

BurbleLabs may offer a referral reward (currently $5 USD, subject to change without notice) to an existing user ("Referrer") when a person they refer ("Referred User") joins the Platform and meets the qualifying activity described below.

Qualifying condition: A referral reward is only earned once the Referred User has completed and had approved a minimum of 1 (one) hour of cumulative Recording time as a Contributor, verified through BurbleLabs' standard quality review process. Recordings that are pending, rejected, or later reversed for fraud do not count toward this threshold.

Referral rewards are subject to the following conditions:

  • The Referrer and Referred User must be different individuals and may not share an account, household, device, payment method, or IP address in a manner that suggests the referral is not genuine.
  • Self-referrals, and referrals created solely to generate rewards without genuine independent use of the Platform, are not eligible and may result in forfeiture of the reward and suspension of both accounts.
  • The 1-hour qualifying threshold, the reward amount, and the referral program itself may be changed, paused, or discontinued by BurbleLabs at any time, including for referrals already in progress, provided that rewards already earned and approved prior to such a change will still be honoured.
  • BurbleLabs may audit referral activity at any time and reverse rewards found to be obtained fraudulently.

10. Data licensing and intellectual property

10.1 Licence to BurbleLabs. By submitting a Recording, you grant BurbleLabs a worldwide, royalty-free, sublicensable, transferable licence to use, reproduce, process, review, transcribe, and licence the Recording (including any voice, speech content, and associated metadata) to Buyers for the purpose of training, testing, evaluating, and developing artificial intelligence and speech technology systems, and for BurbleLabs' internal quality assurance and platform operations.

This licence survives your withdrawal from the Platform with respect to Recordings already licensed to a Buyer prior to that withdrawal, as described in Section 5.4.

10.2 Buyer use. Buyers licence Recordings and datasets from BurbleLabs under a separate agreement between BurbleLabs and the Buyer. BurbleLabs represents to Buyers that Recordings have been collected with consent as described in Section 5, but does not guarantee any specific outcome, accuracy, or fitness for a Buyer's particular use case.

10.3 No ownership transfer of your voice. You retain your underlying rights of publicity and personal identity. The licence granted is limited to the use described above and does not permit BurbleLabs or Buyers to use your name, likeness, or voice in a way that identifies you personally outside the context of anonymised or pseudonymised training data, except where you have separately and explicitly agreed to that use.

10.4 Platform IP. The Platform, including its software, design, trademarks, and content (excluding Recordings and user-submitted content), is owned by BurbleLabs and protected by intellectual property law. You may not copy, modify, reverse-engineer, or create derivative works from the Platform except as expressly permitted.

11. Buyers

Access to the dataset catalogue and submission of a purchase inquiry does not itself create a binding agreement. Dataset sales, pricing, licensing terms, and delivery are governed by a separate written agreement executed between BurbleLabs and the Buyer.

12. Prohibited conduct

In addition to Section 6, you agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable law
  • Attempt to access another user's account or data without authorisation
  • Use bots, scripts, or automated means to generate Calls, Recordings, or reviews
  • Reverse-engineer, scrape, or extract data from the Platform outside normal use
  • Interfere with the operation or security of the Platform
  • Circumvent the review or payment process, or attempt to manipulate quality scoring

13. Suspension and termination

We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or if required to do so by law. Upon termination, any pending Earnings obtained through violation of these Terms may be forfeited; Earnings validly obtained prior to termination will be paid out subject to the standard withdrawal process.

You may close your account at any time by contacting us. Sections that by their nature should survive termination (including Sections 5.4, 8.6, 9, 10, 15, 16 and 17) will survive.

14. Privacy

Our collection and use of personal data, including voice data, is described in our Privacy Policy, which forms part of these Terms. BurbleLabs processes personal data in accordance with applicable data protection law, including GDPR where applicable, and provides contributors with rights to access, withdraw consent, and request deletion as described there and in Section 5.4.

15. Disclaimers

The Platform is provided "as is" and "as available." To the maximum extent permitted by law, BurbleLabs disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Platform will be uninterrupted, secure, or error-free, or that any particular level of Earnings will be achievable.

16. Limitation of liability

To the maximum extent permitted by law, BurbleLabs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Platform. BurbleLabs' total liability for any claim arising from these Terms or the Platform will not exceed the greater of (a) the amount you were paid by BurbleLabs in the 12 months preceding the claim, or (b) $100 USD.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death, personal injury caused by negligence, or fraud.

17. Indemnification

You agree to indemnify and hold BurbleLabs harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your Recordings, or your violation of any law or third-party right — including, in the case of a Contributor, any failure to obtain proper consent from a Call Participant.

18. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified to you via the Platform or email at least 14 days before taking effect. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

19. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Platform will be resolved through binding arbitration in Delaware, except that either party may seek injunctive relief in the courts of Delaware. This governing law provision does not override any mandatory consumer protection rights you may have under the law of your country of residence.
